Child Support Income Caps in New York

If you have a high income or your spouse has a high income, it is important that you retain an attorney familiar with the New York child support income caps. When a New York judge calculates a child support obligation, he or she will take into account the parties combined parental income. However, there is a cap, or maximum amount of income which the court will initially consider.

Previously, the maximum combined parental income considered by courts in calculating child support was $80,000. Pursuant to new legislation, the maximum combined parental income that will be considered in a child support calculation is $130,000.
