Issues in Child Custody

At the law firm of Macht, Brenizer & Gingold, there are many factors that will determine the custody of a child. These include:

  • What is the age and maturity level of the child?
  • Which parent has had more influence in raising the child or was the primary caregiver?
  • Will the child be kept in the same school district or area?
  • Are there issues of physical abuse, neglect or drug abuse in the household?

As an aside, the fitness of the other parent can be conceded if one parent has left the home and the children with the other spouse.

Relocation in Child Custody

When one parent intends to relocate and wants to relocate the children as well, there are also many factors that the court will consider, including the new location, if family is nearby, if the move is for an improvement in economic conditions of the household, and if the previous involvement of the other parent and, of course, the best interests of the child, among other factors.

When both parties agree to a relocation, court will not be necessary. However, when there is a conflict, it is important to bring an objection to the relocation before the move occurs, because the courts are reluctant to disturb a child's new life once it is established.
